California Attorney General Kamala Harris, who walked away from negotiations last year, and who last week again rejected the deal as ?inadequate,? was reportedly in last-minute talks Monday with the White House to try to resolve her objections.?California may be?critical to the success of any deal because it remains ground zero of the housing crisis. Roughly one in four of all foreclosures are happening in the state and?ten of the top 20 metro areas with the highest foreclosure rates in 2011 are there, according to RealtyTrac.

Massachusetts?Attorney General Martha Coakley filed suit against the five banks in December for illegal and deceptive foreclosure practices.

The five big banks are expecting to get relief from such lawsuits if they agree to the settlement. Coakley said last month that calls?about mortgage and foreclosure problems, after quadrupling over the past two years, have become her office?s most common consumer complaint.

Now, with some states still wavering, the administration is weighing whether a partial deal is its best option.?

The latest version of the settlement would take a multi-pronged approach to unraveling the aftermath of the mortgage mess that sank the housing market, tossed more than seven million households on the street, and created a legal morass for lenders and a red tape nightmare for borrowers trying to modify their loans and keep their homes.

One major component involves a detailed set of procedures that banks would agree to follow in processing foreclosures. Spelled out in dozens of pages, a complex set of rules would try to end some of the most abusive practices that began surfacing two years ago in private lawsuits challenging ?robo-signing? and other deceptive and fraudulent practices. In return, lenders would be granted relief from civil actions challenging those practices from the AGs that sign on to the deal. (Individuals would be free to continue filing lawsuits against banks for deceptive and illegal foreclosures.)

The other major component of the state-federal settlement centers on a promise by the big five lenders to expand the volume of loans they modify for homeowners who are struggling to make their monthly payments. Depending on how many states sign on,? lenders would be required to write as much as $17 billion worth of modifications by applying a series of strategies, including?writing down principal,?cutting interest rates, or lowering monthly payments.

The settlement would grant bankers credits toward the $17 billion figure, based on a complex formula that gives bankers more credit for the most costly strategies. The least costly modifications might earn a lender as little as a nickel; the costliest would generate a dollar-for-dollar credit. ?The banks would be required to use a minimum portion of credits?to cut principal balances, a modification most lenders have balked at under the voluntary HAMP program.

Lenders have two years to generate credits worth 75 percent of the total and three years to meet the full goal. The proposed $17 billion target could be scaled back depending on how many states ultimately agree to the deal.?

If the pace of loan modifications falls short, lenders will have to pay the government a penalty by converting the remaining unearned credits into cash. A monitoring committee of state and federal officials will track the pace of modified loans, with penalties kicking in after 24 and 36 months if the lender fall short of targets spelled out in the deal.

The settlement also tries to resolve one of the thorniest problems clogging the modification process: the widespread conflict when different lenders hold first and second mortgages on the same property. Rewriting a first mortgage typically leaves the holders of the second mortgage empty handed. Under the terms of the proposed settlement, the five banks would agree to work together and negotiate losses on those second liens.

To sweeten the deal for the states, a portion of the settlement would be paid in cash to fund two separate programs. One would divert money to local foreclosure relief programs in states that sign on. The other would?provide cash settlements, averaging about $1,800, to homeowners who can show they were subjected to abusive practices or wrongful foreclosures. (Detailed procedures for those claims have yet to be resolved.)

The authors of the deal believe the system of credit will give the states more leverage in accelerating the pace of loan modifications; bankers get more credit for modifying loans in the first year, for example. Based on other incentives built into the credit formula, lenders could eventually provide as much as $32 billion in loan relief to meet the $17 billion in credits, according to a source close to the talks.

But proponents of the deal concede that, even if all works as planned, the universe of households that would be eligible is relatively small. The settlement would apply only to loans held on the books of the five big banks. That would exclude homeowners whose mortgages are owned or guaranteed by Fannie Mae and Freddie Mac, the government-sponsored lenders?that hold more than half of all U.S. mortgages. Loans sold off by the banks to investor-owned mortgage pools would be subject to modification only?if the contracts that created those pools allow it.

More Canadians think it is a ?good idea? to reallocate budget increases from medical care to benefits for families

Canadians want to make family a priority ? 85 per cent want to spend more time with their families and 60 per cent want governments to support policy changes that make it easier to raise a family, according to a national poll by McAllister Opinion Research about research led by University of British Columbia professor Paul Kershaw.

?Despite having all the amenities of modern life, two-thirds of Canadians resist the idea that today?s families have it easier than in the past,? said Kershaw.?The McAllister poll examined public attitudes about the degree to which we prioritize family time and responsibility in this country. This is the second set of data to come out of the poll; earlier data examined Canadians? attitudes about public funding priorities.

The poll shows that 60 per cent of Canadians ?agree? or ?somewhat agree? that ?compared to what is spent in other areas, Canadian governments do not do enough for families raising young kids today.? Accordingly, 60 per cent indicated they would ?vote for a politician who has publicly committed to fighting for better government policies for families with young children.?

Kershaw, an associate professor at UBC?s Human Early Learning Partnership (HELP), said, ?it is far more common that today both parents need to work in order to eke out a standard of living that is often lower than one salary could achieve a generation ago.?

The poll reveals that 62 per cent of Canadians think it?s a good idea to invest in ?New Mom and New Dad benefits,? which would make it affordable for all parents, including the self-employed, to spend up to 18 months at home with newborns ? splitting the leave between moms and dads.

Sixty-six per cent of Canadians think it?s a good idea to ?subsidize $10-a-day quality child care? and 80 per cent of Canadians think it?s a good idea to invest in more flex-time, allowing parents more flexibility and time at home.

Recognizing that Canada is experiencing tough economic times, the poll shows that Canadians are willing to make hard choices to pay for these programs and services including revisiting sacred cows like medical care increases, or tax cuts.

When asked specifically about reallocating recent spending increases from medical care and investing it in family policy instead, only 37 per cent of Canadians responded that this was a ?bad idea,? compared to 42 per cent that thought it is a ?good idea,? and 21 per cent that were unsure.

More Canadians also think it is a ?good idea? than a ?bad idea? for all Canadians to contribute to new family policies through their income taxes, including a slim majority of Canadians under 45.

Kershaw noted that combined federal, provincial, and municipal revenue is down more than $90 billion as a share of our economy today compared to 1980, while over the same period, medical care spending is up $47 billion.

?When we choose to cut the total revenue pie by $90 billion, but increase the slice for medical care by $47 billion, we leave $137 billion less for other priorities.? The generation raising young kids is definitely feeling this pinch, because it now means Canada has very weak family policy by international standards.?

Kershaw released this data on February 7 in Ottawa following an invited presentation to the Government of Canada Standing Committee on Health.

Last fall, UBC Professor Paul Kershaw and colleagues at HELP compared the costs of living, household incomes and services available to families in Canada today with those during the 1970s and found that young couples today are raising families with less money and time than the Baby Boomer generation.

Kershaw has proposed policy changes to make it easier to raise a family, called the ?New Deal for Families.? These changes include enabling mothers and fathers to stay at home with newborns until they reach at least 18 months of age, providing quality child care services that cost no more than $10 per day, and allowing employees and employers to use flex-time to better balance time spent at work with time spent at home.

These most recent polling data shows that the majority of Canadians support the ?New Deal for Families.? Recognizing that Canada is experiencing tough economic times, the poll also shows that Canadians are willing to make hard choices to pay for these programs and services including revisiting sacred cows like medical care increases, or tax cuts.

?The cost of the New Deal for Families would amount to less than a cup of coffee and doughnut at Tim Hortons: $1.67 per day and the poll showed us that more than half of Canadians are willing to spend that on investing in families,? said Kershaw.

New Criteria Could Change Who Is Diagnosed With Alzheimer's (HealthDay)

MONDAY, Feb. 6 (HealthDay News) -- New guidelines for diagnosing the mental decline that can come with several diseases of aging may create confusion among doctors and patients about who has early Alzheimer's disease and who simply has mild cognitive impairment, a new report warns.

Mild cognitive impairment (MCI) is a mental decline in its earliest stages that's not a normal part of aging. Under previous guidelines, a patient was considered to have MCI if he or she had marked, but mild, memory problems but was otherwise functioning normally, explained Dr. John Morris, director of the Alzheimer's Disease Research Center at Washington University School of Medicine in St. Louis.

Recently, the U.S. National Institute on Aging and the Alzheimer's Association convened a work group to update criteria for MCI. Their revised guidelines cast a wider net for what qualifies. "As MCI was studied further, it was found that people with MCI often had other impairments in reasoning, visual-spatial skills and attention," Morris said.

Under the new guidelines, people with MCI can have also have problems doing daily activities, such as driving without getting disoriented, remembering to pay bills and paying the proper amount, and cooking safely. People can have MCI even if they depend on aids or assistance to complete those tasks.

Previously, what distinguished MCI from dementia was that ability to function, but the new guidelines blur the distinction, Morris noted.

"Now, there is no distinguishing line between mild cognitive impairment and mild Alzheimer's disease dementia," said Morris, who lays out his argument in an analysis published online Feb. 6 in the Archives of Neurology. "Broadening the criteria for MCI overlaps so much with the diagnosis of very mild Alzheimer's disease that physicians won't know whether to call it very mild Alzheimer's or MCI. It adds confusion to the field."

Morris' study included more than 17,500 people with a mean age of 75 who had either normal memory and thinking skills, MCI or Alzheimer's disease dementia.

He concluded that 99.8 percent of patients currently diagnosed with "very mild" Alzheimer's dementia and just under 93 percent of those diagnosed with "mild" Alzheimer's dementia could be reclassified as having MCI, based on the revised criteria.

Some 5.4 million Americans have Alzheimer's, according to the Alzheimer's Association.

While MCI can be a first sign of the Alzheimer's, it's not necessarily so. Other causes of MCI can include medications, stroke or depression, Morris explained.

Diagnosing Alzheimer's disease is typically done through a clinical examination with a neurologist. Neuroimaging tests are conducted, to rule out other conditions that might have caused the mental decline, such as a stroke or brain tumor.

Other means of diagnosing Alzheimer's include a spinal tap that looks for certain biomarkers in the spinal fluid or specialized MRIs that can detect amyloid protein, which is associated with Alzheimer's. However, these are not typically available outside of large metropolitan hospitals or as part of medical studies.

Dr. William Thies, chief medical and scientific officer for the Alzheimer's Association, said researchers now understand that Alzheimer's is a continuum of changes in the brain that begin years, and possibly decades, before the first MCI symptoms are noticed. Alzheimer's itself, Thies said, represents "the very last, devastating changes of the disease."

"You can do a lot of damage to the brain before it will not do all the functions it's supposed to do," Thies said. "There is a period of time when you will have silent changes in your brain structure and function, a pre-symptomatic period when the changes have already begun."

Because Alzheimer's is a continuum, that means that drawing a line between MCI and Alzheimer's is, by definition, "artificial," he noted.

"We recognize those lines are artificial, and at the moment because the criteria are relatively new, they remain somewhat fuzzy," Thies said. "This is an area where we will have continued discussion over the next few years to establish consistently where to categorize folks."

When Alzheimer's is believed to be the underlying cause of MCI, physicians can offer up a diagnosis of "MCI due to AD [Alzheimer's disease]," Morris said.

Even though the diagnosis of Alzheimer's is more devastating than MCI, it's important for patients and their families to hear the truth, so that they can come to terms with the diagnosis and make the necessary plans, Morris said.

"When we think the MCI is caused by underlying Alzheimer's disease, we should go ahead and call it very early Alzheimer's," Morris said. "It's artificial to call it MCI."

According to background information in the article, 30 percent to 60 percent of doctors conceal an Alzheimer's disease diagnosis because of causing distress to the family and the patient, even though 94 percent of the same doctors would reveal a diagnosis of terminal cancer.

Dr. Gayatri Devi, an attending neurologist at Lenox Hill Hospital in New York City, said that as a result of the new criteria, "large numbers of patients will be classified as having mild cognitive impairment when in fact they're suffering from Alzheimer's disease."

"This complicates research in the area, and confuses patients and families, not to mention physicians, who've relied on functional independence as the demarcation between Alzheimer's disease and MCI," Devi said.
